Terms & Conditions

    1. Scope

    These T&Cs apply to all services provided by genesisfilms. Any conflicting terms provided by the Client are not applicable.

    2. Cooperation

    The Client ensures that all information, permits, and content required for production are provided in a timely manner.

    3. Acceptance

    Upon delivery of the edit, the Client has 7 working days to provide feedback. If no feedback is received, the work is deemed accepted. Subsequent changes will be billed at an hourly rate.

    4. Usage Rights

    Usage rights (unlimited in time/territory for Web, Social Media, Internal, Submissions) are granted only upon full payment of the total invoice. Delivery of raw footage (rushes) is not included. genesisfilms may use the work for self-promotion.

    5. Intellectual Property

    All works created under the contract (videos, graphics, concepts) remain the property of genesisfilms until full payment. Music, stock material, and other third-party content are used in compliance with licensing terms. The Client is responsible for clearing any rights related to materials they provide.

    6. Payment Terms

    Payment terms are specified on each invoice. In case of late payment, default interest of 9.2 percentage points above the respective base rate according to ยง 456 UGB (Austrian Commercial Code) will be charged. All prices are exclusive of statutory VAT.

    7. Confidentiality

    Both parties agree not to disclose confidential information shared during the collaboration to third parties. This applies particularly to unpublished content, trade secrets, and strategic information. The confidentiality obligation continues after termination of the contractual relationship.

    8. Data Protection

    Personal data is processed in accordance with GDPR and the Austrian Data Protection Act. If personal data is processed during production (e.g., footage of individuals), the Client is responsible for obtaining the necessary consents. Further information can be found in our Privacy Policy.

    9. Force Majeure

    In the event of force majeure (e.g., natural disasters, pandemics, strikes, government orders, extreme weather conditions) that make the execution of the contract impossible or significantly more difficult, both parties are released from their obligations. In such cases, an alternative date will be agreed upon or the contract will be terminated by mutual consent. Services already rendered will be compensated proportionally.

    10. Warranty

    Defects in the work must be reported in writing within 6 months of delivery. genesisfilms will remedy justified defects through rectification. Further warranty claims are excluded to the extent permitted by law.

    11. Liability

    genesisfilms is only liable for damages caused by intent or gross negligence. Liability is in any case limited to the value of the respective contract. No liability is assumed for indirect damages, lost profits, business interruption, or data loss. The Client is responsible for the legal admissibility of the content. The Client shall indemnify and hold genesisfilms harmless against any third-party claims arising from materials provided by the Client. Claims under this contract expire 6 months after becoming aware of the damage, but no later than 3 years after delivery.

    12. Cancellation

    In case of cancellation after booking, all services rendered plus a cancellation fee will be charged: 30% of the total amount up to 14 days before the shoot, 50% thereafter, and 100% within 48 hours of the scheduled shoot.

    13. Final Provisions

    Austrian law applies. The place of jurisdiction is the registered office of genesisfilms. Should any provisions of these T&Cs be invalid, the validity of the remaining provisions shall remain unaffected.
